Awka – God’s Own Secondary School, Umuchu has dragged the West African Examinations Council (WAEC) to court for wrongfully excluding its students from the on-going external examinations conducted by the council.
The suit FHC/AWK/CS/52 was instituted by the school, the chairman of board of directors, Hon. Chukwuma Ezeugwu, chairman of Parents Teachers Association (PTA) mr. Basil Umeanozie, Principal and Proprietor Mr. Chima Anyikwa and 29 of the students.
They have dragged WAEC, head of national office of WAEC Mr. Olutise Isaac Adenipekun and Awka branch controller Mr. H. A. Igwe as defendants.
In their 18 paragraph statement of claim, they said among other things that 53 students were certified by the ministry of Basic Education, Awka as candidates for May/June 2019 WASSCE and assigned to A Padua Business Centre ,Ekwulobia for uploading.
They also claimed that that their fees were paid in instalments totalling N739,350 being N13,950 for each of the of students.
The plaintiffs were issued reciepts for the payments. The reciepts, they claimed carried uploading pin numbers with the preferred business operator.
However, to the shock of the plaintiffs only 24 out of the 53 students were printed out and the defendants closed its website.
All entreaties to make the defendants upload the remaining 29 students proved abortive.
For that reason the plaintiffs continued, they had no choice than to drag the defendants to court as the defendants have up to now not opened its website to upload the same remaining 29 students to enable them take the examination they paid for.
The defendants said the brought the suit because the defendants action ran counter to the students fundamental Human Rights.
They also sought the order of the Federal High Court Awka to compel the defendants to upload the data of the 29 students to enable them write the ongoing WASSCE.
In addition they are demanding N5million as general and aggravated.
